The following property was seized in LMM Int’l Airport,Carolina,PR,on December 31,2008,and is subject to forfeiture under the provisions of Title 19,United States Code,Section 1595a(c)(2)(C),Title 15,United States Code,Section 1124 and Title 19,Code of Federal Regulations,Sections 133.22;133;23 and 133.42:
Approximately 2,490 watches bearing Swatch,Breitling and Volcom Trademarks with an approximate domestic value of $7,451.00
A notice of Intent to Forfeit will be published in the “EL Nuevo Dia” newspaper for three consecutive weeks.The dates of publication are July 15,22,and 29,2009.Any person desiring to claim property must comply with one of the following requirements:
1.Under the Civil Asset Forfeiture Reform Act(CAFRA),any person asserting an interest in the property must file a claim without posting a cost bond if all CAFRA requirements were previously complied with,in default of which the seized property will be declared forfeited and disposed of in accordance with law.The claim must be filed with the FP&F Officer,at the San Juan Customhouse,within twenty(20) days from the date of the first publication; except in those instances were previously notification is not received,the claim must be filed within thirty(30) days from the date of the last publication.
2.Under all Non-CAFRA and CAFRA cases in which CAFRA requirements were not complied with,any person asserting an interest in the property must file a claim and cost bond in the sum of $5,000.00 or 10 percent of the value of the property,whichever is lower,but not less than $250.00,in default of which the seized property will be declared forfeited and disposed of in accordance with law.The claim and cost bond must be filed with the FP&F Officer,at the address found above,within 20 days from the date of the first publication.
