生命健康权在人的诸多权利中无疑是最为重要的,然而,我国法律现阶段对生命权的保护远远不足,令笔者十分担忧.本文对生命权进行探讨,拟为今后我国宪法与部门法对生命权的保护提供理论支持.文章运用历史分析、比较分析、规范分析等研究方法,对生命权的涵义、发展历史、我国生命权法律保护现状、对生命权法律保护的建议和应当注意的问题等进行了探讨.笔者认为,生命权是以自然人的生命安全利益为内容的权利,具体包括生命安全维护权和生命利益支配权.它不同于作为公民最低生活保障权的生存权.国际社会的有关人权宣言和公约以及世界各国宪法大都规定了生命权,保障生命权已经成为一种全球化的潮流.我国现行法律制度对生命权保护存在许多问题,我们应尽快在根本大法中明确规定生命权,并加强在部门法中对生命权的保护.总之,我们必须善待生命,尊重生命权.
