PETITIONER’S BRIEF IN SUPPORT OF APPEAL OF DECISION TO THE ADMINISTRATIVE APPEALS OFFICE (AAO)
STATEMENT OF FACTS
Petitioner, ABC, INC., filed an I-140 Immigrant Petition for Alien Worker on behalf of Beneficiary, Mr. XYZ seeking to classify the Beneficiary under the Employment-Based First Preference (EB-1) category as a Multinational Executive or Manager. On November 1, 2005, USCIS issued a Request for Evidence (RFE) to Petitioner. On January 20, 2006, Petitioner submitted its response with attached evidence, which USCIS found to be insufficient, as asserted in its denial dated July 23, 2008. USCIS denied Petitioner’s I-140 petition for two reasons: the first was because it found Petitioner to be acting as a “mere agent or office of a foreign entity abroad” as opposed to a company deemed to have been “doing business” for one year (defined as “the regular, systematic, and continuous provision of goods and/or services by a firm, corporation, or other entity”); the second reason being that it found that Petitioner “failed to establish that the proffered position qualifies as executive or managerial”. With regard to both components of the USCIS's decision, Petitioner has presented compelling evidence to the contrary.
I. PETITIONER FULFILLS THE REQUIREMENT OF “DOING BUSINESS” AS REQUIRED UNDER THE REGULATIONS
The Petitioner, ABC, INC., is a wholly-owned subsidiary of the parent company, DDDDD Ltd., of the DDDDD (Shanghai Automotive Industry Corporation) Group of companies. A global company, the DDDDD Group has 39 companies worldwide and as of 2007, earned annual revenues of $XXXX billion.
DDDDD develops automotive components to supply OEM’s all over the world. The DDDDD group maintains numerous operations, such as manufacturing, logistics, sales, service, international trade, research and development, and material procurement. DDDDD has established five overseas locations across North America, Europe, Japan, and Korea for the import and export of components and finished cars.
Petitioner, ABC, INC., is the DDDDD group’s North American company. Established in 19XX, and located in XXXX, Michigan, USA, ABC, INC. currently has XX employees and has total sales exceeding $XX million and $XX million for 2006 and 2007, respectively.
