一个英语语法问题

这两句一句用being questioned,一句用Given.有什么区别啊?第2句为什么不可以改为being given?

第一句用being questioned 是因为upon是介词,后面必须用doing形式,而被问,又是被动语态,所以是doing+done的形式＝being questioned ．
第二句是一般现在时,说的是一般情况,所以在时态上就一般现在就可以了,由于是被动关系,give是非谓语动词,所以只能用done的形式．也就是given.
