2012年3月31日,国家版权局公布了《中华人民共和国著作权法》修改草案的第一稿,首次从国际上引入“追续权”的概念,著作权法草案第十一条第二款第十三项规定“追续权,即美术作品、摄影作品的原件或者作家、作曲家的手稿首次转让后,作者或者其继承人、受赠人对该原件或者手稿的每一次转售享有分享收益的权利,追续权不得转让或者放弃.”随后《著作权法》修改草案第二稿将追续权的实施范围限定于通过拍卖方式转售的艺术品.最后的《著作权法》修订草案第三稿中,追续权的规定没有变动.目前来看追续权制度在我国建立已成定局.
追续权是一项特殊的著作权制度,是一种特殊的财产权利,目前虽然国际上确立追续权制度的国家不多,但追续权自一百年前诞生以来不断被越来越多的国家所接受,证明了其存在的合理性.本文分五章分别阐述了追续权的概念、性质和国际立法状况,分析了追续权的理论基础,以及我国引入追续权制度的合理性和意义, 并提出了一些追续权制度建立上的建议.
