An agency of necessity arises in situations of urgent necessity,usually from some accident and it is impossible for the agent to contact the person in whose interest he acts.The application of the agency of necessity is restricted in modern times because,due to modern forms of communication,it is rare that the agent or bailee cannot communicate with the person whose interests he seeks to protect.An example of a situation where an agency of necessity will be created is where perishable goods in the custody of a bailee begin to deteriorate.The bailee must then act in good faith and for the benefit of the owner of the goods either by exercising the power to sell the goods which the law confers on him or by taking steps to prevent further deterioration.
